Introduction
These Terms of Use (“Terms”) govern your access to and use of MatchPaint, including the website at https://matchpaint.app, the MatchPaint mobile app, MatchPaint+, MatchPaint Pro Desktop, and related materials, tools, and features (collectively, the “Service”).
By accessing or using MatchPaint, you agree to these Terms. If you do not agree, do not use the Service.
1. MatchPaint Is a Color Workflow Tool
MatchPaint is designed to assist with color discovery, color comparison, paint matching, palette management, barcode-assisted paint lookup, imported color libraries, export workflows, and Desktop Pro production handoff. MatchPaint is a decision-support tool, not a substitute for professional judgment, physical color verification, manufacturer specifications, or final project approval.
2. Accounts, Purchases, and Access
MatchPaint Standard and MatchPaint+ may be distributed through mobile app stores. MatchPaint Pro Desktop may be distributed separately through an external purchase path. Certain features may require a paid version, subscription, license, entitlement, or supported device capability.
Prices, features, availability, purchase paths, and supported platforms may change over time. Any purchases made through Apple, Google, Gumroad, or another third-party storefront may also be subject to that storefront’s own terms, billing rules, refund rules, and account requirements.
3. User Content and Local Data
You are responsible for the colors, palettes, imported libraries, images, project information, exported files, and other content you create, import, save, share, or export using MatchPaint. MatchPaint is designed around local processing and local storage, as described in our Privacy Policy.
You are responsible for keeping backups of any files, palettes, reports, libraries, or project materials that are important to your workflow.
If you import, reference, rename, or use third-party color libraries, including Pantone, PMS, Adobe, manufacturer, or other proprietary swatch resources, you are responsible for ensuring that you have the necessary rights, licenses, permissions, or lawful access to use those materials. MatchPaint does not grant, transfer, supply, or replace any third-party license for proprietary color systems or swatch libraries.
4. Color Matching Disclaimer
MatchPaint provides closest-match recommendations based on digital color data, supported libraries, imported swatch resources, and available matching methods. MatchPaint does not guarantee that any suggested match will be an exact visual or physical match in all conditions.
Actual paint appearance may vary due to screen calibration, lighting, surface texture, sheen, substrate, product line, paint formulation, tinting systems, store mixing equipment, application method, drying time, aging, environmental conditions, and other real-world factors outside of MatchPaint’s control.
Before purchasing paint or applying it to a project, you should verify all color selections with physical samples, drawdowns, test patches, manufacturer materials, or professional judgment. You are solely responsible for final color approval, paint selection, ordering, and application decisions.
5. Retail Barcode and Store Workflows
Barcode-assisted workflows are intended to reduce friction when identifying or ordering supported paint colors. MatchPaint does not control third-party stores, in-store systems, product availability, barcode scanners, tinting machines, employee actions, pricing, inventory, or final order fulfillment.
You should confirm all paint names, codes, bases, sheens, quantities, and order details with the relevant retailer, manufacturer, or paint professional before purchasing or applying paint.
6. Desktop Pro and MPCompanion
MatchPaint Pro Desktop and MPCompanion are intended to support production workflows and design handoff. You are responsible for reviewing exported files, palette sheets, reports, measurements, dimensions, and Illustrator panel outputs before relying on them in client, vendor, print, fabrication, or installation workflows.
7. Acceptable Use
You agree not to misuse MatchPaint or attempt to interfere with its normal operation. You may not:
- Reverse engineer, decompile, or attempt to extract source code except where allowed by law
- Bypass licensing, subscription, entitlement, or feature-gating controls
- Use MatchPaint in a way that violates applicable law or third-party rights
- Upload, import, or distribute content you do not have the right to use
- Represent MatchPaint recommendations as manufacturer-certified matches unless separately verified
8. Intellectual Property
MatchPaint, including its design, interface, branding, software, text, graphics, workflows, and related materials, is owned by MatchPaint or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of MatchPaint or any MatchPaint intellectual property to you.
Third-party paint brand names, product names, trademarks, and color references remain the property of their respective owners. Their inclusion is for identification, compatibility, comparison, or workflow purposes and does not imply endorsement unless expressly stated.
Pantone, PMS, Adobe, and other third-party color library names or references, when shown or supported, remain the property of their respective owners. MatchPaint compatibility with imported libraries does not mean those libraries are included, licensed, endorsed, or authorized by MatchPaint unless expressly stated.
9. No Warranties
MatchPaint is provided “as is” and “as available.” To the fullest extent permitted by law, MatchPaint makes no warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, or error-free operation.
10. Limitation of Liability
To the fullest extent permitted by law, MatchPaint is not liable for paint purchases, color discrepancies, application results, labor costs, project delays, repainting, replacement materials, lost profits, lost data, business interruption, or any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of, inability to use, or reliance on MatchPaint.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In those cases, MatchPaint’s liability will be limited to the maximum extent permitted by applicable law.
11. Updates and Changes
We may update MatchPaint, add or remove features, change supported libraries, update barcode data, modify pricing, or revise these Terms from time to time. Continued use of MatchPaint after changes become effective means you accept the updated Terms.

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MatchPaint operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in accordance with applicable law.
